Oenotech Wine laboratory Services – Terms and Conditions
Oenotech Wine Laboratory Services results are only relevant to the sample submitted and it is the producer’s responsibility to ensure accurate representative sample of the entire volume that it represents.
“The Contractor”, although not limited to, shall mean Oenotech Wine Laboratory Services, its subsidiaries, employees, agents, sub-contractors associates or hereafter whom the contactor may arrange any work or task on its behalf.
“The Producer”, although not limited to, shall mean, the customer, owner, proprietor, partner, company director(s)/secretary, firm, business, winery, vineyard, subsidiary, debtor, consigner, representative, associate, or any other agent or contractor, any aforementioned that “The Contractor” performs work for, or performs work on behalf of, paying and non-paying jobs, that is not employed by Oenotech.
“The Service/Job/Work”, although not limited to, is the process of, wine analysis, juice analysis, customer liaison, or any associated procedure thereof, in performing any task or part thereof to be undertaken by Oenotech.
The Producer has seven days from receipt of invoice to query the amount in writing if he/she feels necessary. Otherwise, the invoice amount will be deemed acceptable, final and payable in full by the due date.
Any winemaking instructions or advice given to the Producer is to be treated as a guide only. Any calculations for additions of materials, liquids or other to any content of wine, juice or otherwise, that The Contactor may be suggest, will not be liable under any circumstance for the configuration, manner or quantity of goods added, extracted, blended or otherwise. This is the responsibility of The Producer.
Our Customer invoice payments are strictly 7days (net). Payment is required 15 days following completion of the associated work. Late payment may result in a late fee of $30 per statement sent to the Producer. Any payment not received by the due date stated on the invoice will be deemed a late payment and The Producer hereby agrees to pay the additional fee. However that fee and how it will be applied will be determined entirely by the Contactor. No further credit will be given to account holders who have overdue amounts owing.
Should the Producer continue to default these payment terms stated in “Terms and Conditions” or on the associated invoice(s). The Contractor reserves the right to employ whatever action he/she feels necessary to recover the money quickly as possible. The Contactor is in no way to notify The Producer of intentions as to what course of action may be taken to recover monies owing. The Producer hereby agrees to and will be liable for all related fees and charges associated with the Contractors cost of recovering monies owed by the Producer. The Contactors agent or representatives will not be liable for any publicity, publication or defamation of any description that may result to anyone due to such circumstances.
These terms and conditions are subject to change at any time. The Contactor is obliged to notify the Producer of any change to these Terms and Conditions before any commencement of work.
By requesting work to be done by Oenotech Wine Laboratory Services, you agree to abide by all Terms and Conditions in this Document, which you have read and fully understood.
